1, You are invited to
read the following information very carefully. It constitutes the conditions
under which your booking is accepted. When you make a booking and pay a deposit
a contract has been entered into as soon as we receive and confirm the booking.
You are then bound to pay us for your holiday, and we are obliged to provide
you with the holiday you have booked. Your booking is made on the terms of
these booking conditions and is subject to English laws and the jurisdiction of
English courts. Your contract is with Scuba en Cuba.
2, We reserve the right
to decline any bookings.
3, We are not under any
obligation to dispatch any tickets, vouchers or documents until full payment of
the booking has been received by us or our appointed agent. Monies paid to an
agent will be held by that agent as agent for us from the date when payment is
made to that agent.
Such monies
are at all times held on behalf of Scuba en Cuba as ATOL holder. The agent has
a responsibility to provide the customer with an ATOL receipt or ATOL
confirmation invoice at the time of payment.
4,
Deposit: All
booking forms must be accompanied by a standard deposit of £150 per person
(special deposits apply on some arrangements) as detailed on the holiday or
tour information itinerary sheet. The deposit is your only obligation until
eight weeks before departure.
5,
Reservation and Confirmation: Upon receipt of your booking form and
deposit, we will prepare and issue a confirmation invoice. Please check this
very carefully as any query should be brought to our attention as soon as
possible. The agreement between us will now come into effect and we are both
committed.
6. Holiday
Balance: The
balance due must be paid eight weeks before you travel or as otherwise agreed
by us. If this is not done we reserve the right to cancel your holiday and make
cancellation charges (for charges see 'Cancellation by You'). Please ensure
your balance is promptly paid. If you book your holiday less than eight weeks
prior to departure then the balance is due to be paid immediately the invoice
is sent to you.
7. Late
Bookings: Bookings
received by us eight weeks or less prior to the departure are deemed to be late
bookings. When you make a definite late booking by telephone, letter, fax or
e-mail you must pay the total cost of the booking straight away and we will
then confirm it. Should you subsequently cancel the reservation made, you will
be subjected to the cancellation charges detailed in 'Cancellation by You'. A
late booking may be confirmed by us either by telephone or by a confirmation
invoice.
8. Changes
made by you to your holiday: Circumstances can arise whereby you may wish
to transfer to another holiday or depart on a different date. Once we have
accepted your original booking, and you then wish to change, or alter, any
detail on the booking form, we shall be obliged to levy an alteration fee of
£25 per person. Should you change your date or holiday within eight weeks of
departure, then charges may be levied in accordance with the cancellation fees
detailed below under the heading 'Cancellation By You'.
9. Changes
made by us to your holiday: We plan your holiday tour arrangements in advance and
although it is unlikely that we have to make changes to confirmed arrangements,
circumstances occasionally oblige us to do so. Most changes are of a minor
nature and we will advise you at the earliest date. When any major change
occurs, and provided it does not arise from beyond our control (see 'Important
Force Majeure'), you may accept the revised holiday arrangements, in which case
we will additionally give you compensation as set out below. Alternatively, if
the revised arrangements are not acceptable to you, you may cancel the holiday
and we will refund to you in full all the monies you have paid to us together
with reasonable compensation on the basis set out below. A change to your tour
is one that we made before the day of departure and which involves a change of
airport (except between Gatwick, Stansted and
Heathrow), the outward or return flight being rescheduled by more than 12
hours, a change of city or a change involving the substitution of a hotel with
one of a lower official classification. This does not include a flight delay
when you have checked in. If a substantial change is made more than 42 days
before departure no compensation is payable, then:
29-42 days ............................. £10 per person
15-28 days ............................. £20 per person
0-14 days ............................. £30 per person
Please note
that compensation will not be payable to infants or children.
10.
Important - Force Majeure: Compensation payments do not apply to changes caused by
reason of war, riots, civil strike, terrorist activity, industrial disputes,
failure to issue visas or any other government action, natural and nuclear
disasters, fire, technical problems to transport, closure or congestion of
airports or ports, cancellation or changes of scheduled airline flights, adverse
weather conditions and similar events beyond our control. In case of such event
we will have no liability other than to offer you an alternative
comparable holiday, if available, or to refund all monies paid by you.
11.
Cancellation by You: A
cancellation can only be accepted IN WRITING including e-mail or fax from the
person who signed the booking form. Such cancellations are not effective until
they are actually received by us.
If you or any
member of your party is forced to cancel, please advise us of the reason as you
may be protected by insurance. The cancellation fees levied by us are to
compensate us for the administrative expenses involved in arranging your
holiday as well as the risk we have to accept of not being able to resell the
flight seats and accommodation on the tour.
The scale of
charges is:

cancellations received by us less than 15 days before departure.
12.
Cancellation by Scuba en Cuba: a) We reserve the right in any circumstances
to cancel your holiday, and, in this event, we will return to you all the
monies you have paid us or will offer you an alternative available holiday, of
comparable standard. In no case, except for government action, civil unrest or
war, etc., (see 'Important Force Majeure' above) will your holiday be cancelled
less than 60 days before the departure date.
b) Certain
holidays may require a minimum number of participants and, in the event of such
minimum numbers not being achieved prior to eight weeks before departure, we
shall be entitled to cancel the holiday, whereupon all monies paid by the
customer shall be refunded but no compensation shall be payable or alternative
holiday offered.
13. Our
Liability to You : a),
We accept liability for any loss you may suffer if any part of the holiday
arrangements you book with us is not as described and not of a reasonable
standard. We also accept liability if you suffer death or personal injury as a
result of the holiday arrangements failing to be as described and of a
reasonable standard. However, these acceptances of liability do not apply if
there has been no fault on our part nor on the part of our suppliers and the
loss, death or personal injury suffered is attributable to your own acts or
omissions, the acts or omissions of a third party not involved in providing the
services which make up your holiday, which acts or omissions were unforeseeable
or unavoidable, or were due to unusual or unforeseeable circumstances whose
consequences could not have been avoided or anticipated even exercising all due
care or to an event which, even with all due care, could not have been foreseen
or forestalled. It is a condition of the above that you notify us immediately
on your return from holiday, assign to Scuba en Cuba any legal rights which you
may have against the relevant supplier and co-operate fully with us in respect
of any legal proceedings which we may take against the relevant supplier.
b), Responsibility
to our clients: If any part of the arrangements booked with us is not provided
in the advertised manner we will pay you appropriate compensation if this has
affected the enjoyment of your holiday (see 'Important Force Majeure' above).
You must of course follow the procedure detailed under 'Complaints'.
c)
Flights: Flight times are provided by airlines, they are subject to air
traffic control restrictions, weather conditions, the need for constant
maintenance and the ability of passengers to check in on time. There is no
guarantee that the flights will depart at the time shown on your confirmation
invoice, itinerary or on the tickets which you receive. The timings are
estimates only. We do not have any liability to you for any delay which may arise.
Where such delay does arise, the carrier may provide appropriate meals etc. but
we will not make any such provisions. Further, any flights forming part of the
holiday arrangements will be subject to the conditions in the ticket issued by
or on behalf of the carrying airline which in most cases limit the airline's
liability to the customer in accordance with international Law and Conventions.
d) You must
appreciate that in certain countries services in hotels, on tour and in
restaurants can not be expected to be of the same
standard as those in the UK and the term "reasonable standard" must
be interpreted accordingly. This is particularly important where "liveaboard dive boats" are involved in a tour and the
clear limitations of being on such a small vessel must be accepted.
e) Activities
on some tours, such as diving, carry inherent risks and each person wishing to
participate in such activities may be asked by the supplier to sign additional
forms and in all cases must adhere to the restrictions imposed by the supplier.
All divers booking a diving package must have a full and recognised diving
certificate.
f) It is your
responsibility to ensure that you are in possession of current personal
documentation, including a passport valid for all countries to be visited and
that where applicable, all innoculations have been
carried out and health certificates are available. We cannot under any
circumstances be responsible if you are not permitted entry into any country.
In such cases normal cancellation charges will apply. Cancellation will be
deemed to have occurred on the date on which we learn of the refusal of visa or
permission to enter.
g) We cannot
be liable for any medical expenses incurred by you or any loss or additional
costs incurred as a result of injury or sickness. You may be covered against
such circumstances under your holiday insurance policy.
We cannot be
responsible for loss or damage to baggage, personal effects, money or
documents. Your holiday insurance may cover you for such losses.
14. Charges:
No
price surcharges will be made within 31 days of departure. The holiday price is
subject to surcharge on the following items: transportation costs, including
the cost of fuel, dues, taxes or fees at ports or airports, or the exchange
rate applied to the particular package. Even in this case, we absorb an amount
equivalent to 2% of the holiday price which excludes insurance premiums and any
amendment charges. Only amounts in excess of this 2% will be surcharged. If
this results in an increase of holiday price of more than 10% you will be
entitled to cancel the holiday and a full refund of all the money paid except
for any premium paid to us for holiday insurance and amendment charges. The
right to cancel must be exercised within 14 days from the issue date printed on
the invoice.
15. We reserve the right
to request any person to withdraw from the holiday if we deem their acts or
conduct to be offensive or to be incompatible with the other clients, and we
shall be under no further liability thereafter to any such person.
16. No refund or
compensation will be made or given for any unused hotel accommodation or any
other unused service or feature of the tour nor will such accommodation,
services or feature be exchangeable for other accommodation, services or
features or transferable to other persons.
17.
Brochure Information: The
Scuba en Cuba brochures or information sheets contain statements representing
its honest belief that the facts as shown are correct. Every reasonable attempt
will be made to supply what has been described.
We reserve
the right to make changes to the information, prices and itineraries set out in
the brochure and provided such changes have been notified to you prior to you
submitting a booking form or accepted by you after submission of the booking
form prior to our confirmation then such changes shall be binding on the
parties.
A selection
of airlines and types of aircraft will be used for your holiday. Details can be
confirmed at the time of booking.
18,
Complaints
In the event
of any dissatisfaction with the accommodation or any other service provided by
us in the resort the matter must be reported immediately to the local
representative, agent, or hotelier so that action can be taken to remedy the
problem. If the supplier of the service is unable to deal with your problem or
complaint, you must write to us within 28 days of your return from holiday.
You must
appreciate that we will need to investigate your complaint and, if you do not
tell us immediately about it on your return, our ability to investigate may be
seriously hampered. Should that prove to be the case, we reserve the right to
reject your complaint.
19.
Insurance: It
is a requirement of booking that you are insured. If you do not take insurance
through us you should forward details of your insurance policy with another
company for our records.
20. Your Financial Protection
When
you buy an ATOL protected flight or flight inclusive holiday from us you will
receive an ATOL Certificate. This lists what is financially protected, where
you can get information on what this means for you and who to contact if things
go wrong.
We, or the suppliers
identified on your ATOL Certificate, will provide you with the services listed
on the ATOL Certificate (or a suitable alternative). In some cases, where neither
we nor the supplier are able to do so for reasons of insolvency, an alternative
ATOL holder may provide you with the services you have bought or a suitable
alternative (at no extra cost to you). You agree to accept that in those
circumstances the alternative ATOL holder will perform those obligations and
you agree to pay any money outstanding to be paid by you under your contract to
that alternative ATOL holder. However, you also agree that in some cases it
will not be possible to appoint an alternative ATOL holder, in which case you
will be entitled to make a claim under the ATOL scheme (or your credit card
issuer where applicable).
If we, or the
suppliers identified on your ATOL certificate, are unable to provide the
services listed (or a suitable alternative, through an alternative ATOL holder
or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust
may make a payment to (or confer a benefit on) you under the ATOL scheme. You
agree that in return for such a payment or benefit you assign absolutely to
those Trustees any claims which you have or may have arising out of or relating
to the non-provision of the services, including any claim against us, the
travel agent (or your credit card issuer where applicable). You also agree that
any such claims may be re-assigned to another body, if that other body has paid
sums you have claimed under the ATOL scheme.
For packages
not including flights, clients’ monies are protected by the existence of a
trust account, in compliance with the Package Travel Regulations 1992.
Scuba en Cuba does not store your financial
details and will only pass on information that is necessary towards making a
booking on your behalf to/with the relevant suppliers.
